Our practice: Land Use and Real Estate Development

Our lawyers have substantial experience helping clients successfully navigate the full range of land use and real estate development issues, including complex planning and zoning, land use and environmental permitting, urban growth boundary amendments, annexations, appeals, development agreements and related matters. We have a state-wide practice and have represented clients in numerous jurisdictions throughout the Portland metropolitan area and the State of Oregon on a wide variety of projects, including retail buildings, transportation projects, master-planned communities, energy facilities, office buildings, distribution centers, destination resorts, golf courses and wineries.

We understand that for a developer time is money. Our services are designed to shorten the project timeline, prevent government overreaching, avoid delays and convince officials to be flexible and creative. We pride ourselves in fostering strong working relationships with government officials and have extensive contacts throughout the State of Oregon. These relationships are extremely helpful in moving a project quickly and successfully through the approval process.

Nonetheless, we understand that there are times when project developers cannot reach a workable agreement with permitting agencies or have extensive public opposition and must resort to appropriate tactics. Our lawyers have significant experience representing clients on complex and controversial projects and know what it takes to overcome governmental and public resistance. We understand the importance of building a proper record in all cases, and when warranted, successfully use appeals to achieve the desired result or enable an acceptable resolution through negotiations. Our lawyers have significant experience and success representing clients in appeals before the Oregon Land Use Board of Appeals, Court of Appeals and Supreme Court. Our practice: Real Estate Transactional

Tying up and acquiring real property is an important part of the development process and our lawyers have experience drafting and negotiating a wide variety of real estate transactions, including purchase and sale agreements, option agreements, easements and deed. Negotiating a real estate transaction usually boils down to understanding the client's business priorities and the motivations of the other party. We believe that the lawyer's primary job is to get a deal closed while protecting the client's interest, not to be a barrier to the deal or cause for delay. We pride ourselves in resolving complex and difficult deals in a cost-effective manner that protects the client's interests and avoids future disputes.

Our work continues after the project is complete. We have extensive experience with complex and simple leases relating to all types of space. We are skilled in structuring and negotiating leases for companies of all sizes, from small office lease renewals to build-to-suit and long-term ground leases. We work with both landlords and tenants on a consistent basis.

Our practice: litigation

At times, litigation cannot be avoided and we are well versed in the courtroom. We have tried and won real estate related cases throughout the state involving condemnation, easement disputes, improper SDC charges, construction defects and development agreements. As we do in all our practice areas, when we represent clients in a litigation setting we work closely with our clients to devise the best strategy for their businesses based on the particular circumstances of the case. We are committed to learning our clients' businesses and the industries in which they operate.
